SCHOOL staff left in limbo due to a redundancy tug-of-war will be “treated as trespassers” and forced off site if they turn up to work.
Trustees at breakaway school The Hawthorne’s have fired off the warning to staff at the axed schools it was set up to replace – St Wilfrid’s high in Litherland and Bootle’s St George of England high, where it will be based.
Around 100 staff have been left in limbo due to a row heading to the High Court between Sefton council chiefs and trustees over whether the employees should automatically transfer to the free school, which if the case would be responsible for any subsequent redundancy payouts.
Known as Transfer of Undertakings Protection of Employment Regulations (TUPE) Sefton Council insist it applies – just like it does in the case of centrally-funded academies.
But after taking advice from the Department for Education trustees believe it does not as The Hawthorne’s is a “new entity”.
The new centrally-funded school opens for the first time for a staff-only “inset day” on Monday and jilted employees face the humiliation of being escorted off the premises if they show up.
Today defiant staff said they will risk the public ousting and hand in signed forms confirming they believe they are still employees.
And in line with union advice they will present themselves for work.
Signing the forms would protect the affected staff should the High Court declare that TUPE does apply in a case that could set a precedent.

Just a thought but will they change the name of the new school when all this is sorted. It was given ' The Hawthornes' name as it was on Hawthorne Road, but it is now going to be on Fernhill Road
The best thing about being over the hill is that now I can have some fun and free-wheel down the other side. LET THE GOOD TIMES ROLL.

What happened to all the staff? Did they keep their jobs or get proper redundancy money ? or was it all sorted out secretly as is usually the case?
